Alleging the Circumstances Constituting Fraud under Florida Law

Under Florida law, when alleging a claim for misrepresentation (fraud), a party must also allege the circumstances constituting fraud with such particularity as the circumstances may permit.  However, the intent and knowledge of a person, which are required elements of a claim for misrepresentation, may be alleged generally.  See Rule 1.120(b) of Fla. R. Civ. P.
